These General Terms and Conditions («Terms») govern all orders placed through the online shop at www.prosecco.co.com. By placing an order you accept these Terms. Please read them carefully; they contain important information about your right of withdrawal and the minimum-age requirement for the purchase of alcoholic beverages.
§ 1 Provider & Scope
The shop is operated by M.E. Boumahdi, trading as Prosecco & Co, Nelkenweg 2, 9141 Gösselsdorf, Austria (VAT ATU81146635), e-mail admin@luxusgmbh.com («we», «us», «the Seller»). These Terms apply to all contracts concluded via this online shop between us and the customer. A consumer is any natural person who concludes a legal transaction for purposes predominantly outside their trade, business or profession (§ 1 KSchG).
§ 2 Minimum Age — Protection of Minors
Our products are alcoholic beverages. The sale of alcohol to minors is prohibited. You must be at least 18 years of age to use this website and to place an order. By using this website and submitting an order, you warrant and confirm that you are at least 18 years old and that you are legally entitled to purchase alcohol in your country of residence. We are entitled to refuse or cancel orders and to verify age where there is doubt. Goods are handed over by the carrier only to a person who is demonstrably of legal age; the carrier may request photo identification on delivery.
§ 3 Conclusion of the Contract
The presentation and description of goods in the online shop does not constitute a binding offer but an invitation to the customer to place an order. By clicking the «Order with obligation to pay» button at the end of the ordering process, you submit a binding offer to purchase the goods in your basket. We will confirm receipt of your order immediately by e-mail; this confirmation of receipt does not yet constitute acceptance. The contract is concluded when we send you a separate order confirmation by e-mail or when we dispatch the goods. The text of the contract is stored by us and the order details are sent to you by e-mail; the applicable Terms are made available to you in a form that allows storage and reproduction.
§ 4 Prices & Payment
All prices are final prices and include the statutory value-added tax. The applicable VAT rate is determined by the country of delivery and is calculated at checkout. Shipping costs are not included in the item price and are shown separately during the ordering process before you submit your order. The payment methods available are displayed during the order process; we offer payment via PayPal, credit and debit card, Apple Pay, Google Pay, EPS bank transfer, and Klarna. Card, Apple Pay and Google Pay payments are handled by our payment service providers. Payment is due upon conclusion of the contract.
§ 5 Delivery, Shipping Restrictions & Transfer of Risk
Unless otherwise stated in the product description, delivery takes place within a maximum of 7 working days; where payment is made by PayPal, this period begins on the day after the payment order is issued. We deliver only to the countries offered at checkout. Because the cross-border sale and shipment of alcohol is subject to legal restrictions, we may be unable to deliver to certain countries or regions. For consumers, the risk of accidental loss or deterioration of the goods passes to you only upon handover of the goods to you or to a recipient designated by you.
§ 6 Right of Withdrawal & Returns (Consumers)
If you are a consumer, you have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day on which you, or a third party other than the carrier and indicated by you, acquire physical possession of the goods (or the last item, in the case of an order of several goods delivered separately).
To exercise the right of withdrawal, you must inform us — M.E. Boumahdi (Prosecco & Co), Nelkenweg 2, 9141 Gösselsdorf, Austria, admin@luxusgmbh.com — of your decision to withdraw by an unequivocal statement (e.g. a letter sent by post or e-mail). You may use the model withdrawal form below, but it is not obligatory. To meet the withdrawal deadline, it is sufficient to send your communication before the withdrawal period has expired.
Effects of withdrawal. If you withdraw, we will reimburse all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive standard delivery offered by us), without undue delay and no later than 14 days from the day on which we are informed of your decision. We will use the same means of payment you used for the initial transaction, unless expressly agreed otherwise; in no event will you incur any fees as a result. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent them back, whichever is earlier. You must send back or hand over the goods to us without undue delay and in any event no later than 14 days from the day on which you communicate your withdrawal. The deadline is met if you send the goods before the 14-day period has expired. You bear the direct cost of returning the goods. You are liable only for any diminished value of the goods resulting from handling other than what is necessary to establish their nature, characteristics and functioning.

Voluntary 30-day return. In addition to the statutory 14-day right of withdrawal set out above, and without restricting it, we grant you a voluntary right to return your order within 30 days of receipt. This voluntary return applies on condition that the goods are returned complete, intact and undamaged, in their original, unopened packaging and fit for resale. The direct cost of returning the goods is borne by you. Once we have received the goods back in proper condition, we will refund the purchase price using the same means of payment you used for the order. Your statutory right of withdrawal under this section remains fully unaffected by this voluntary arrangement.
§ 7 Retention of Title
The goods remain our property until the purchase price has been paid in full.
§ 8 Statutory Warranty for Defects
The statutory provisions on warranty for defects (Gewährleistung) under Austrian and EU consumer law apply. Where the goods are defective, you are entitled to the statutory remedies. This does not affect any voluntary guarantee that may be granted by the producer.
§ 9 Limitation of Liability
We are liable without limitation for damages caused intentionally or by gross negligence, and for personal injury. For slight negligence we are liable only for the breach of essential contractual obligations and limited to the foreseeable damage typical of this type of contract. Any further liability is excluded to the extent permitted by law. Mandatory liability under the Product Liability Act (PHG) remains unaffected.
§ 10 Online Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
§ 11 Governing Law & Jurisdiction
These Terms and the contractual relationship are governed by Austrian law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG) and conflict-of-law rules. For consumers, this choice of law applies only to the extent that it does not deprive you of the protection of mandatory provisions of the law of your country of habitual residence. The statutory place of jurisdiction applies to consumers.
§ 12 Final Provisions
Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected. We reserve the right to amend these Terms with effect for the future; the version in force at the time of your order applies to that order. The current version is always available on this page.
